Opinion

No. 05-05-00313-CV

Opinion Issued March 11, 2005.

Original Proceeding from the 298th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 02-06165.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the trial judge erred in not yet ruling on his motion to disqualify opposing counsel. Based on the record presented, we conclude relator has failed to show the trial judge clearly abused his discretion in not yet ruling on relator's motion to disqualify opposing counsel. Accordingly, relator's petition for writ of mandamus is DENIED. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding).
