Petition for review granted; transferred to Court of Appeal, Second Appellate District, Division Five, with directions to issue an alternative writ
The petition for review is granted. The matter is transferred to the Court of Appeal, Second Appellate District, Division Five. That court is ordered to vacate its summary denial dated April 23, 2021, and is further ordered to refile the petition for writ of mandate and to issue an alternative writ directing the Secretary of the Department of Corrections and Rehabilitation to hold petitioner's nonviolent offender parole hearing no later than July 28, 2021, or, in the alternative, to show cause why the relief requested should not be granted. (In re Gadlin (2020) 10 Cal.5th 915; In re Gadlin (2019) 31 Cal.App.5th 784, 790.) Any response to the order to show cause shall be filed August 13, 2021.
