IN RE FREIGHT TRANSPORTATION SERVICE, INC. and Juan Castro
This proceeding arises out of Cause No. 2023-CI-00778, styled Andrea Lauzen, Individually and as Next Friend of J.B., a minor; Robert Bielec; and Kathryn Beilec, Plaintiffs; Marcus Robert Green, Cross-Plaintiff/Defendant v. Freight Transportation Service, Inc.; Juan Castro; and Marcus Robert Green, Defendants, pending in the 45th Judicial District Court, Bexar County, Texas, the Honorable Mary Lou Alvarez presiding.
Sitting: Luz Elena D. Chapa, Justice, Irene Rios, Justice, Lori I. Valenzuela, Justice.
ORDER
PER CURIAM.
On November 1, 2023, relators filed a petition for writ of mandamus and an emergency motion to stay the deposition of Todd Hall. On November 6, 2023, real parties in interest filed an objection and response to relators' emergency motion for stay. This court believes a serious question concerning the mandamus relief sought requires further consideration. See Tex. R. App. P. 52.8(b). Respondent and real parties in interest may file a response to the petition filed in this court no later than November 30, 2023. Any such response must conform to Texas Rule of Appellate Procedure 52.4.
Relators' emergency motion is GRANTED. The trial court's September 26, 2023 "Order on Defendants' Motion to Quash" wherein the trial court denied relators' motion to quash allowing real parties in interest to depose Todd Hall is STAYED pending further order from this court.
It is so ORDERED.
