Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Sherman Marvin Frank, has filed a petition for writ of mandamus to compel the trial court to rule on his motion for discovery so that he can obtain documents necessary to seek habeas relief.

The underlying case is State of Texas v. Sherman Marvin Frank, cause number 810774-C, pending in the 339th District Court of Harris County, Texas, the Honorable Jesse McClure III presiding.

We deny the petition. See TEX. R. APP. P. 52.8(a) (providing for denial of petition if relator does not establish entitlement to relief); 52.7(a) (relator must file certified or sworn copy of document material to request for relief).
