On February 5, 2024, relator, TaKasha Francis filed a petition for a writ of mandamus challenging, among other things, the trial court's January 29, 2024 order setting the underlying litigation for trial beginning February 8, 2024, at 1:00 p.m. The underlying lawsuit was filed by the Honorable Robert K. Schaffer against Mike Doyle, in his representative capacity as the Chair of the Harris County Democratic Party, and the Harris County Democratic Party.
On February 13, 2024, the Court issued an opinion stating that "[o]ur review of Francis's mandamus petition reflect[ed] that she ha[d] failed to establish that she [was] entitled to mandamus relief," and further that "we deny Francis's petition for writ of mandamus."
On February 20, 2024, Francis filed a "Request for Clarification of Court's Opinion." In her request, Francis stated that it "appear[ed]" to Francis that the Court's opinion only addressed her emergency request to stay the February 8, 2024 trial setting. Therefore, Francis stated that clarification was necessary "[t]o avoid an argument that this Court did not rule on [r]elator's compliant regarding Judge Kennedy, a 'visiting judge' acting ultra vires as not being properly assigned as a visiting judge." Francis requested that the Court clarify its decision "that the denial of all mandamus relief included [r]elator's issues related to the appointment of the visiting judge."
Francis's request for clarification is denied. As stated in the Court's February 13, 2024 opinion, the Court concluded that Francis "failed to establish that she [was] entitled to mandamus relief," and the Court therefore "den[ied] Francis's petition for writ of mandamus." As stated by Francis in her request for clarification, the Court's opinion was a "denial of all mandamus relief" requested by Francis, and, as such no clarification is necessary.
