Opinion

No. 05-09-00482-CV

Opinion issued May 7, 2009.

Original Proceeding from the County Court at Law No. 4, Dallas County, Texas, Trial Court Cause No. cc-09-01703-d.

Before Justices MOSELEY, FITZGERALD and LANG-MIERS.

Opinion by Justice MOSELEY.

MEMORANDUM OPINION

Relator contends the trial court erred in granting real party in interest's Rule 202 petition to take relator's deposition. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 837 (Tex. 1992). Accordingly, we DENY relator's petition for writ of mandamus.
