MEMORANDUM OPINION


Relators Fluor Corporation and Fluor Enterprises, Inc. have filed a petition for a writ of mandamus complaining of Judge Sebesta's October 3, 2003 discovery order. Since the time this mandamus proceeding was filed, Judge Sebesta has vacated his October 3, 2003 order, and relators have filed a motion to dismiss their petition.

The Honorable Patrick Sebesta, judge of the 239th District Court of Brazoria County, Texas. The underlying lawsuit is Lonas v. A C S, Inc., No. 17656*JG01 (239th Dist. Ct., Brazoria County, Tex.).

We grant the motion and dismiss as moot the petition for a writ of mandamus.
