ORIGINAL PROCEEDING WRIT OF MANDAMUS
165th District Court Harris County, Texas
Trial Court Cause No. 2017-06871
MEMORANDUM OPINION
On March 8, 2018, relator Fiesta Mart, L.L.C. (Fiesta) filed a petition for writ of mandamus in this court. See Tex. Gov't Code Ann. § 22.221 (West Supp. 2017); see also Tex. R. App. P. 52. In the petition, Fiesta asks this court to compel the Honorable Ursula Hall, presiding judge of the 165th District Court of Harris County (Respondent), to: (1) enter an order granting its motion for medical examination of the real party-in-interest, Hilberto Molina, or (2) alternatively, rule on the motion.
Fiesta also filed a motion asking our court to stay proceedings below.
Our court requested Molina to file a response to the petition by March 14, 2018. Molina filed a motion, asking our court for an extension of time to file his response until March 27, 2018.
On March 12, 2018, the trial court provided our court a copy of an order granting Fiesta's motion for medical examination of Molina. Accordingly, the petition for writ of mandamus and motions pending before our court are now moot.
We therefore dismiss relator's petition for writ of mandamus and motion for stay, and Molina's motion for extension of time as moot.
PER CURIAM Panel consists of Justices Boyce, Donovan, and Wise.
