ORDER OF REMAND


The cases on the attached list were removed to this Court on the ground that they are "related to" the bankruptcy of Federal Mogul Global, Inc. Many of the cases were subsequently provisionally transferred to the District of Delaware. On February 8, 2002, the District of Delaware denied the transfer of the cases to the District of Delaware and remanded them to the state courts from which they were originally removed. Some of there moving defendants appealed. On July 31, 2002, the Third Circuit held that it does not have appellate jurisdiction of the district court's transfer/remand decision and denied defendants' mandamus petition Accordingly, those cases that were provisionally transferred to the District of Delaware are no longer pending in this Court and will be removed from the Court's docket.

With respect to those cases that were removed to this Court, but have not been provisionally transferred to the District of Delaware, the Court concludes, for the reasons stated by the District of Delaware, that it does not have subject matter jurisdiction of such cases and hereby REMANDS the cases to the state courts from which they were removed.

Furthermore, to the extent any files in the cases on the attached list are located in the Clerk's office of the Northern District of California, such files shall be returned to the state courts from which they were originally removed.

IT IS SO ORDERED.
