ORDER GRANTING CHAPTER 11 TRUSTEE'S MOTION TO SHORTEN BY TWO DAYS THE NOTICE PERIOD RELATED TO THE CHAPTER 11 TRUSTEE'S MOTION PURSUANT TO 11 U.S.C. § 105 (a) AND 363 (b) FOR AN ORDER AUTHORIZING AND APPROVING TERMS OF A RETENTION AND EMERGENCE PLAN FOR CERTAIN KEY EMPLOYEES


This matter came before the Court on the Motion of Keith L. Phillips (the "Trustee"), the duly appointed Chapter 11 Trustee for the above-captioned debtors (the "Debtors") for an Order shortening by two days the notice period related to the Chapter 11 Trustee's Motion Pursuant to 11 U.S.C. § 105 (a) and 363 (b) for Entry of an Order Authorizing and Approving Terms of a Retention and Emergence Plan for Certain Key Employees (the "Motion"). The Motion was made pursuant to Rule 2002 (a)(2) of the Federal Rules of Bankruptcy Procedure on the grounds that there is "cause" for shortening the twenty-day notice period. The Court finds that it is essential to the success of these Chapter 11 cases that the Chapter 11 Trustee's Motion Pursuant to 11 U.S.C. § 105 (a) and 363 (b) for Entry of an Order Authorizing and Approving Terms of a Retention and Emergence Plan for Certain Key Employees (the "Retention Plan Motion") be considered by the Court at the hearing on June 18, 2002 at 2 p.m. (the "Hearing"). The Court, therefore, concludes that "cause" exists to shorten the notice period. Accordingly, finding it reasonable and necessary to do so,

It is hereby ORDERED that:

1. The notice period related to the Retention Plan Motion is shortened in order to accommodate the Court's consideration of that motion at the Hearing.

2. The deadline for parties in interest to object to the Retention Plan Motion is June 14, 2002 at 4:00 p.m.

3. The Clerk of Court shall send a copy of this Order as entered to movant's counsel at the address below who will then distribute the Order to all creditors and parties in interest in these cases pursuant to the Local Rules.
