  1. In re Fischer

Case No. 03-13704-NA, Adversary Proceeding No. 03-01222 (Bankr. D. Md. Jan. 13, 2009)

The bankruptcy system cannot function appropriately if a trustee must resort to a tug of war to secure documents that properly should be turned over to her. In re Farmer, 237 B.R. 210, 213 (Bankr. M.D. Fla. 1999). On this record, however, I cannot say that either Rosenblatt or Schimel, on behalf of their client Fischer, proceeded other than in good faith in asserting defenses to production of records.

Failing to turnover tax returns to chapter 7 trustee can result in the denial of discharge under ยง 727(D)

In addition to imposing affirmative duties on the Debtors, these provisions impress the policy that a debtor who voluntarily submits him or herself to the jurisdiction of the bankruptcy court to obtain the benefit of a discharge of debts, must fulfill certain duties to insure that estate assets are administered in accordance with applicable law. In re Farmer, 237 B.R. 210, 212 (Bankr.M.D.Fla. 1999); In re McDonald, 25 B.R. 186, 189 (Bankr. N.D.Ohio 1982). The Debtors' Returns are imperative to allow the Trustee to assess what portion, if any, of the Debtors' tax refunds are property of the estate and to collect and administer the refunds in accordance with the Bankruptcy Code. Lubman v. Hall (In re Hall), 174 B.R. 210, 215 (Bankr.E.D.Va. 1994).

  3. In re Tingler

    No. 99-30387 (Bankr. E.D. Ky. Apr. 26, 2001)

In re Yonikus, 974 F.2d 901, 904 (7th Cir. 1992). See also In re Farmer, 237 B.R. 210 (Bankr.M.D.Fla. 1999) (explaining debtor's mandatory duty to relinquish financial books and records to chapter 7 trustee without need for formal discovery request, hearing or order.) The debtor and his counsel assert, and have asserted at certain junctures along the long path leading to this point, that the debtor was not entitled to any of the moving bonus/Relocation Bonus until he completed one year of service with Ford at its Louisville, Kentucky plant which he did post-petition on September 22, 1999 and that he did not receive the funds until post-petition.
