DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Kings County, dated September 20, 2021. Motion by the appellant to stay enforcement of the order, pending hearing and determination of the appeal or, in the alternative, in effect, for a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to stay enforcement of the order is granted, and enforcement of the order is stayed pending hearing and determination of the appeal; and it is further, ORDERED that the branch of the motion which is, in the alternative, in effect, for a preference in the calendaring of the appeal is denied as academic.
