ORDER GRANTING FOURTH INTERIM APPLICATION OF McCARTHY TÉTRAULT, LLP, FOR AWARD OF ATTORNEYS' FEES AND REIMBURSEMENT OF EXPENSES
THIS CASE came on for hearing on September 20, 2004 ("Hearing"), upon the Fourth Interim Application of McCarthy Tétrault, LLP ("McCarthy") filed with the Court on August 30, 2004 ("Application") (Doc. No. 1227), for award of interim fees in the amount of US$41,031.52 and actual expenses in the amount of US$9,985.33 on behalf of R.W. Cuthill, Jr. ("Cuthill"), as Chapter 11 Trustee of Evergreen Security, Ltd., from August 1, 2003 through May 31, 2004 ("Fourth Interim Application Period"). The Court, having considered the Application, noting the objection of the Steering Committee, having heard the testimony of Cuthill in favor of the Application, and having heard from the United States Trustee and all counsel present at the Hearing, determined that McCarthy should be awarded fees and expenses as set forth below. Accordingly, it is hereby
ORDERED:
1. The objection of the Steering Committee is overruled.
2. The Application is granted.
3. A reasonable fee for the services rendered during the Fourth Interim Application Period by McCarthy is hereby determined to be US$41,031.52.
4. A reasonable amount for actual expenses incurred by McCarthy during the Fourth Interim Application Period is US$9,985.33.
5. Upon this order becoming final, Cuthill is hereby directed to pay McCarthy the amount of US$41,031.52 for services and US$9,985.33 for actual expenses for a total of US$51,0176.85.
