INSANE PERSONS, § 30contract with incompetent as void. In action to recover from estate of incompetent for legal services rendered at request of incompetent to secure his discharge from insane institution in habeas corpus proceeding, where it appeared that trial court recognized that alleged contract with incompetent was void but entered judgment for claimants for $2,250 upon theory that they had rendered necessary services and were entitled to reasonable compensation therefor, held that judgment would be sustained upon remittitur of $1,000 by claimants, otherwise judgment would be reversed and cause remanded for new trial.

Appeal from the Circuit Court of Cook county; the Hon. HARRY M. FISHER, Judge, presiding.

Judgment affirmed upon remittitur; otherwise reversed and remanded for new trial. Heard in the second division, first district, this court at the February term, 1946.
