Opinion

Gen. No. 43,193. (Abstract of Decision.)

Opinion filed May 29, 1945 Rehearing denied June 12, 1945 Released for publication June 14, 1945

ESTATES OF DECEDENTS, § 134assets discovered after son's death not assets of estate of father who died before him. Where son died 16 months after father, leaving cash, stocks and bonds in safety deposit box which heirs of father contended were misappropriated from father's estate and were assets of said estate, and son's widow and children contested this; and evidence indicated that father's sole asset at time of his death consisted of savings bank account; that he had not been employed for several years; that decedent son did not reside with father, and had engaged in securities transactions for many years, and nearly all assets in safety deposit box represented transactions prior to father's death, held finding that contents of safety deposit box were assets of son's estate, was supported by the evidence.
