No. 05-20-00374-CV
05-22-2020
ESTATE OF RONALD W. HUGHES, SR., DECEASED
On Appeal from the Probate Court No. 1 Dallas County, Texas
Trial Court Cause No. PR-16-01987-1
ORDER
The clerk's record is overdue. On May 20, 2020, the Court received a letter from Deputy Clerk Trinidad Pimentel informing the Court that, due to an error, she needs the assistance of appellant's counsel to complete the clerk's record. Mrs. Pimentel's numerous attempts to contact counsel have gone unanswered. Accordingly, we ORDER Michael Russell, counsel for appellant, to contact Mrs. Pimentel to assist him as needed in completing the preparation of the clerk's record. On the Court's own motion, we extend the time to file the clerk's record to June 11, 2020. We caution appellant that if the clerk's record is not filed by June 11, 2020 due to the lack of necessary cooperation from appellant's counsel, the appeal may dismissed for want of prosecution. See TEX. R. APP. P. 37.3(b).
The reporter's record is also overdue and the court reporter has informed the Court that appellant has not requested preparation of the record. By letter dated April 21, 2020, the Court instructed appellant to provide, within ten days, written verification that she has requested preparation of the reporter's record and has paid or made arrangements to pay the reporter's fee. We cautioned appellant that failure to comply may result in an order that the appeal be submitted without the reporter's record. See id. 37.3(c). As of today's date, appellant has not responded. Accordingly, we ORDER this appeal submitted without the reporter's record. See id.
We DIRECT the Clerk of this Court to send a copy of this order to John Warren, Dallas County Clerk; Mr. Pimentel; Jackie Galindo, Official Court Reporter for Probate Court No. 1; and, all parties.
