GIFTS, § 13 — when evidence does not establish inter vivos gift of securities. In proceeding to discover assets of deceased, consisting of securities alleged by respondent to have been subject of inter vivos gift to him by deceased, held that evidence clearly showed that deceased did not make nor intend to make gift of securities to respondent and that latter's conduct was not that of donee or owner.
