Opinion
No. 04-13-00371-CV
12-20-2013
IN THE ESTATE OF MILDRED ELIZABETH THOMAS EDWARDS DECEASED
From the Probate Court No 1, Bexar County, Texas
Trial Court No. 2010-PC-0827-A
Honorable Polly Jackson Spencer, Judge Presiding
ORDER
On September 23, 2013, we abated this appeal because the appellant, William Rowland Edwards, was an alleged debtor in an involuntary bankruptcy proceeding. See TEX. R. APP. P. 8.1.
On November 15, 2013, Edwards filed a motion to reinstate this appeal. Attached to his motion was a certified copy of a memorandum opinion and order dismissing the involuntary bankruptcy proceeding. Although no response to this motion was filed, on December 2, 2013, appellee Marcus P. Rogers, in his capacity as dependent administrator, filed a suggestion of a second bankruptcy. See TEX. R. APP. P. 10.3. In this notice, Rogers states that Edwards filed a voluntary bankruptcy proceeding in the Northern District of Texas on November 27, 2013. The notice complies with Rule 8.1. See TEX. R. APP. P. 8.1.
Edwards's motion to reinstate this appeal is therefore DENIED. This appeal remains ABATED. For administrative purposes, this appeal will continue to be treated as a closed case, unless and until it is reinstated or severed in accordance with Rule 8.3. See TEX. R. APP. P. 8.3.
