Opinion

No. 70-119.

December 15, 1970.

Appeal from County Judges' Court, Dade County; George T. Clark, Judge.

Stephen R. Magyer, Orlando, for appellant.

Paul Revere Berglund, and Richard M. Gale, Miami, for appellee.

Before PEARSON, C.J., and CHARLES CARROLL and BARKDULL, JJ.

The appellant filed a petition for revocation of the probate of the will of Michael M. Jansen. After trial of the issues presented the trial judge denied the petition. Appellant's sole contention on this appeal is that as a matter of law (no record of the trial being presented to this court) the will was not dispositive of the estate. The order appealed is affirmed upon authority of In re Levy's Estate, Fla.App. 1967, 196 So.2d 225, 229.

Affirmed.
