ORDER OF CONSOLIDATION


Pursuant to the order of consolidation entered in lead case H-01-3624, Newby v. Enron Corp. et al., on December 12, 2001, and the order of transfer from the Judicial Panel on Multidistrict Litigation ("JPML"), the above referenced case, H-03-2308, is hereby CONSOLIDATED into H-01-3624.

In light of the transfer effected by the JPML, the Court

ORDERS that Defendant Jeffrey K. Skilling's motion to stay (#69) and Plaintiffs' renewal of motion to remand or abstain and motion for expedited ruling (#112) are MOOT. The Court further

ORDERS that the Alabama Securities Commission's motion for leave to file brief of Amicus Curiae (#29) is GRANTED. The Court will address the original motion to remand (#28) shortly.

The Court also gives notice, however untimely, to counsel in H-03-2308 that a scheduling conference for the Newby and Tittle actions is set before this Court at 9:00 a.m. in Courtroom 9C on July 10, 2003.
