ORDER OF CONSOLIDATION


Pursuant to the order of consolidation entered in lead case H-01-3624,Newby v. Enron Corp. et al. on December 12, 2001, and the transfer order from the Multidistrict Litigation Panel, the above referenced case, H-02-4149, is hereby CONSOLIDATED into H-01-3624.

Moreover, pending before the Court in H-02-4149 is Defendant J.P. Morgan's agreed motion for extension of time (instrument #4) until November 11, 2002 to respond to Plaintiff Benjamin M. Goode's complaint, is GRANTED. Pursuant to the order entered in Newby on August 7, 2002 (#983), all claims not encompassed within Lead Plaintiff's consolidated complaint (#441) are STAYED as indicated in that order. Thus the agreed motion for extension of time is MOOT.
