ORDER


Pending before the Court in the above referenced cases is Bank of America's Opposed Motion for an Order that Bank of America May Participate in Discovery Without Prejudice to Its Position on the Motions of Silvercreek and CALPERS Regarding Their Tardy Requests for Exclusion from the Class Settlement with Bank of America, filed on May 13, 2005. Given the urgency in light of the deposition schedule, the Court
