ORDER OF DISMISSAL


Third-Party Plaintiff Arthur Andersen LLP has filed a Notice of Dismissal Without Prejudice under Federal Rules of Civil Procedure 41(a)(1)(i) and 41(c). Third-Party Defendants Bank of America Corporation, Bank of America, N.A., Banc of America Securities Limited, and Banc of America Securities LLC have not filed answers or motions for summary judgment. Accordingly, it is

ORDERED, ADJUDGED and DECREED that all claims asserted in these actions in the Third-Party Petitions of Arthur Andersen LLP against Third-Party Defendants Bank of America Corporation, Bank of America, N.A., Banc of America Securities Limited, and Banc of America Securities LLC are hereby dismissed without prejudice, with each party to bear its own costs, expenses and attorney's fees.
