ORDER GRANTING APPLICATIONS FOR ALLOWANCE OF INTERIM COMPENSATION AND REIMBURSEMENT OF EXPENSES
Upon the Applications for Allowance of Interim Compensation and Reimbursement of Expenses (the "Interim Applications") for professional services rendered and expenses incurred; and the Fee Committee appointed by the Court, together with its retained professionals, having (1) reviewed the Applications and the respective supporting documentation, (2) met or discussed with the respective applicants the amounts requested and appropriateness of certain of the fees and expenses requested and (3) issued reports with respect to the Applications and the amounts requested therein (the "Reports"); and the amounts requested in certain of the Applications having been reduced or deferred on account of issues or positions set forth in the Reports; and notice having been given pursuant to Federal Rules of Bankruptcy Procedure 2002(a)(6) and (c)(2); and an objection (the "Objection") to the Third Interim Application of Andrews Kurth L.L.P., as Special Counsel to the Debtors, for Allowance of Compensation for Services Rendered and Reimbursement of Expenses Incurred for the Period September 1, 2002 through December 31, 2002 having been filed by the Official Committee of Unsecured Creditors; and a hearing having been held before this Court to consider the Applications on December 11, 2003; and due consideration having been given to the Objection; and sufficient cause having been shown therefor, it is hereby:
ORDERED that the Objection is hereby sustained to the extent that the fees of Andrews Kurth, LLP ("A K") shall be subject to a 20% holdback and additional amounts shall not be paid except pursuant to further order of this Court; and it is further
ORDERED that the Interim Applications are GRANTED to the extent set forth in the attached Schedule A.
