ORDER DISALLOWING CLAIM NUMBER 6899 OF CONTROL COMPONENTS, INC.
Upon the objection, dated November 12, 2004 (the "Objection"), of Enron Corp. and EPC Estate Services, Inc. to Claims of Calpine Corporation and Certain Subcontractors, including claim number 6899 of Control Components, Inc. ("Claim No. 6899"); and no response to the Objection to Claim No. 6899 having been filed with the Court other than the response of Calpine Corporation ("Calpine"), dated January 31, 2005; and considering the subsequent Stipulation and Order Resolving Claims of Calpine Corporation and Specified Subcontractor Claims, entered on June 13, 2005, pursuant to which Calpine's asserted no interest in Claim No. 6899; and whereas no other party has asserted an interest in Claim No. 6899 in response to the Objection; and good and sufficient notice having been provided to the attorneys for the statutory committee of unsecured claimholders, the Office of the United States Trustee for the Southern District of New York, attorneys for the Employment-Related Issues Committee, the persons or entities that filed Claim No. 6899 and their attorneys (if known), and any other parties on the Debtors' Master Service List; and it appearing that no other or further notice need be provided; and the Court having determined that the legal and factual bases set forth in the Objection establish just cause for the relief granted herein; and upon all the proceedings had before the Court; and after due deliberation and sufficient cause appearing therefor, it is
ORDERED that Claim No. 6899 is disallowed for all purposes.
