IN RE GLEN ALLEN ENGLE

Original Proceeding

MEMORANDUM OPINION

Glen Allen Engle filed a petition for writ of habeas corpus and request for emergency stay with this Court. Engle's petition alleges that he is currently confined by the Jefferson County Sheriff pursuant to a judgment of contempt issued by the trial judge in Engle's three criminal prosecutions.

This Court lacks original habeas corpus jurisdiction in criminal cases. Ex parte Hawkins, 885 S.W.2d 586, 588-89 (Tex. App.—El Paso 1994, orig. proceeding); see also Tex. Code Crim. Proc. Ann. art. 11.05 (West 2005); Tex. Gov't Code Ann. § 22.221(d) (West 2004) (Court of Appeals has original jurisdiction to issue a writ of habeas corpus in cases in which the person's liberty is restrained because the trial court has found that the person violated an order, judgment, or decree entered in a civil case.). Engle's complaint arises from felony prosecutions. Accordingly, we dismiss the petition for writ of habeas corpus for want of jurisdiction.

PETITION DISMISSED.

PER CURIAM Do Not Publish Before McKeithen, C.J., Gaultney and Horton, JJ.
