ADMINISTRATIVE ORDER ELIMINATING REDUNDANT PAPER NOTICES
On December 2, 2002, this Court issued Administrative Order No. 02-002, "Administrative General Order Establishing Procedures for Filing, Signing, Maintaining, and Verifying Pleadings and Other Documents in the Electronic Case Filing (ECF) System." Since the introduction of CM/ECF in April of 2002, notices required to be mailed by the Clerk have been sent to participating CM/ECF users, electronically through the CM/ECF system, and by first class mail via the Bankruptcy Noticing Center (BNC), creating duplication of notices. As a result, many attorneys have indicated that redundant noticing has created a burden in their office, is wasteful, and serves no purpose. In addition, the Judiciary expects to save a considerable amount of money on mailings by eliminating redundant notices.
This document was amended several times and the most current version is AO No. 05-002, Eighth Amended General Order Establishing Procedures for Filing, Signing, Maintaining, and Verifying Pleadings and Other Documents in the Electronic Case Filing (ECF) System.
In an effort to move forward and rectify these problems, and with the impending elimination of Federal Bankruptcy Rule 9036,
It is hereby
ORDERED, that effective June 13, 2005 paper notices will not be mailed to registered CM/ECF users through the BNC, and registered CM/ECF users will receive notice from the Court via electronically transmission only. Exceptions will be made for newly registered ecf users who will receive duplicate notices for the first thirty days after becoming registered, and the "Notice of the Meeting of Creditors", which will be sent by the BNC and electronic transmission to all ecf users. ORDERED, that electronic transmission of notices by the Clerk will be deemed complete upon transmission.
