In re: ESTATE OF LARRY A. DUGGER, JR., DECEASED

On Appeal from the County Court at Law No. 2

Gregg County, Texas

Trial Court No. 2010-0213-P

Before Morriss, C.J., Carter and Moseley, JJ.

Memorandum Opinion by Chief Justice Morriss

MEMORANDUM OPINION

Donald Pickard and Martha Pickard, appellants, filed their notice of appeal October 12, 2011.

The clerk's record was filed December 29, 2011, and the reporter's record was filed January 9, 2012. The appellants' brief was therefore due February 8, 2012. When neither a brief nor a motion to extend time for filing the same had been filed by February 27, 2012, we contacted appellants' counsel by letter and informed him that, if a brief had not been filed by March 13, 2012, the appeal would be subject to dismissal for want of prosecution. See TEX. R. APP. P. 42.3(b), (c).

We have received no responsive communication or filing. We dismiss this appeal for want of prosecution. See TEX. R. APP. P. 42.3(b).

Josh R. Morriss, III

Chief Justice
