These proceedings arise out of Cause No. 20-274, styled D'Spain Construction L.L.C. v. George Samuel Ludolf, Individually and as Owner/Manager of GSL Ranch LLC a/k/a GSL Ranch; et al., pending in the 451st Judicial District Court, Kendal County, Texas. The Honorable Kirsten Cohoon signed the order at issue in this original proceeding.
On November 30, 2020, relators each filed a petition for writ of mandamus and requested a stay pending final resolution of the petitions for writ of mandamus. This court believes a serious question concerning the mandamus relief sought requires further consideration. See TEX. R. APP. P. 52.8(b). The respondent and the real parties in interest may file responses to the petitions in this court no later than December 16, 2020. Any such response must conform to Texas Rule of Appellate Procedure 52.4.
Relators' request for temporary relief is GRANTED. The trial court's October 14, 2020 "Order Granting Motion for Limited Discovery" and the trial court's November 10, 2020 "Order on Third Party Rowena Kneupper's Motion to Quash Deposition & For Protective Order" are STAYED pending final resolution of the petitions for writ of mandamus.
It is so ORDERED on this 1st day of December, 2020.
