DISMISS; Opinion filed July 25, 2012
On Appeal from the 304th Judicial District Court
Dallas County, Texas
Trial Court Cause No. 09-839-W
MEMORANDUM OPINION
Before Justices Bridges, Francis, and Lang
Opinion By Justice Bridges
By order dated April 24, 2012, we directed the Dallas County District Clerk, Gary Fitzsimmons, to file by May 21, 2012, either the clerk's record or written verification that appellant's have not paid or made payment arrangements for the clerk's record. We cautioned appellants that if the Court received written verification that they failed to pay or make arrangements to pay for the clerk's record the appeal would be dismissed without further notice. On May 21, 2012, the Court received a letter from the Dallas County District Clerk informing us that his office sent appellants a bill for the clerk's record but it has not received payment.
As of today's date, the clerk's record has not been filed. Accordingly, we dismiss the appeal. See Tex. R. App. P. 37.3(b) & 42.3(c).
