ORDER


This matter came on the Motion for Reconsideration of Order on Motion to Reopen Case to File a Motion for Sanctions Against Bank of America ("Motion") filed by Eugene Edward Downing and Evonne Downing, the Debtors in this case (collectively, the "Debtors"). In their Motion the Debtors request that the Court waive the filing fee of $155.00 to reopen the case, which the Debtors were ordered to pay pursuant to this Court's Order on Motion to Reopen Case to File a Motion for Sanctions Against Bank of America entered on June 14, 2005. Because the reopening of the Debtors' case relates to an alleged violation of the discharge injunction, waiver of the filing fee to reopen the case is proper.

See 9 COLLIER ON BANKRUPTCY ¶ 5010.02, at 5010-4 (15th ed. rev. 2004).

Therefore it is

ORDERED, ADJUDGED AND DECREED that the Debtors' Motion is hereby granted and the filing fee of $155.00 is waived.
