IN RE SARAH DOWNING, Relator

Original Proceeding from the 68th Judicial District Court Dallas County, Texas Trial Court Cause No. DC-20-18959

Before Justices Molberg, Carlyle, and Breedlove

ORDER

MARICELA BREEDLOVE, JUSTICE

Before the Court is relator's June 28, 2024 emergency motion for temporary relief wherein relator asks this Court to stay the jury trial set for July 23, 2024, "as well as all further trial court proceedings" in the underlying suit. Relator stated in her certificate of conference that real party in interest opposed the emergency motion. On July 11, 2024, relator filed a letter with this Court wherein she stated that real party in interest is now unopposed to her motion. Also before the Court is real party in interest's July 11, 2024 unopposed motion for extension of time to file a response to relator's petition for writ of mandamus.

We GRANT relator's emergency motion to the extent that we STAY the jury trial in the underlying suit currently set for July 23, 2024. This stay shall remain in effect until disposition of this original proceeding or until further order of this Court. To the extent relator requested any other relief in her emergency motion, the motion is DENIED.

We further GRANT real party in interest's extension motion. Real party in interest's response, if any, to relator's petition for writ of mandamus must be filed on or before August 9, 2024.
