ORDER ENTERING CASE MANAGEMENT ORDERS NOS. 4, 4A AND 5
The parties submitted proposed Case Management Orders ("CMOs") Nos. 4 and 5 to the Court governing Classes 11, 12, 13, 14, 14A, 15, and 17. On June 20, 2005, the Court issued a Notice of Hearing regarding the proposed CMOs and the matter was heard on July 21, 2005.
The Court finds that adequate notice of the July 21, 2005 hearing regarding the proposed CMOs was provided to all non-settling persons and entities in Classes 11, 12, 13, 14, 14A, 15, and 17. Hartley Hampton, counsel for certain Class 12 claimants, advised counsel for the DCC Litigation Facility, Inc. (the "Facility") of an additional name to be added to Appendix A to CMO No. 5, and the Facility made the correction in a revised CMO No. 5. Only one objection to these CMOs was filed with the Court, from Class 15 claimant Province of Manitoba, which objection was resolved by negotiations between the Facility and Province of Manitoba as memorialized in CMO No. 4A, applicable only to the Province of Manitoba. CMO No. 4 was revised to make clear it was applicable to, among others, all other Class 15 Claimants. Accordingly,
IT IS ORDERED that CMO No. 4, CMO No. 4A, and CMO No. 5, as revised and presented in final form to the Court at the July 21, 2005 hearing, are entered as of this date.
