ORDER APPOINTING NATIONAL LIAISON COUNSEL
In order to ensure that all opt-out litigants are adequately represented on matters of common interest, the Court hereby appoints the following to serve as National Liaison Counsel for all opt-out litigants (except those whose claims are covered by Case Management Orders 4, 4A, and 5):

These lawyers are charged with consulting with other counsel representing opt out plaintiffs and with unrepresented opt out claimants and may formulate and present positions on substantive and procedural issues that affect more than individual cases as they arise during the course of litigation. They are authorized to work with counsel for the Litigation Facility, the Court, and the Special Master in developing and implementing a litigation plan and a mediation plan. They are also authorized to initiate, consistent with Case Management Order 1 and subsequent CMO's, common discovery that may be necessary to assist in the resolution of the claims.
The Court anticipates that Ms. Bryan and Mr. Ellis may delegate some of their responsibilities to the Office of Plaintiffs' Liaison Counsel from MDL-926. That office will be responsible for largely administrative tasks including communications between the Court and other counsel (including receiving and distributing notices, orders, motions, and briefs on behalf of plaintiffs), convening meetings of plaintiffs' counsel to the extent necessary, advising parties of developments, and otherwise assisting in the coordination of activities.
Nothing in this order imposes on Ms. Bryan, Mr. Ellis, or the Office of Plaintiffs' Liaison Counsel any responsibility to provide assistance in any individual case or to provide representation in any individual case.
The terms of this Order may be modified from time to time as the Court deems appropriate.
