AMENDED NOTICE REGARDING APPOINTMENT OF CLAIMANTS' ADVISORY COMMITTEE
Pursuant to Section 4.09(b) of the Settlement Facility and Fund Distribution Agreement, the Special Master has appointed the following persons to serve as the Claimants' Advisory Committee:
1. Sybil Niden Goldrich
2. Ernest Hornsby, Esq. and
3. Dianna Pendleton-Dominguez, Esq.
Members of the Claimants' Advisory Committee shall, as of the Effective Date and continuing until the termination of the Settlement Facility — Dow Corning Trust, and to the fullest extent possible, be immune from liability for official actions taken, or not taken, in good faith as members of the Claimants' Advisory Committee. Further, no member of the Claimants' Advisory Committee shall be liable to any person or entity except for his or her own gross negligence or willful misconduct. No member of the Claimants' Advisory Committee shall be liable for any act or omission of any other agent, counsel, consultant or employee of the Claimants' Advisory Committee unless the Claimants' Advisory Committee member acted with gross negligence or willful misconduct in the selection, retention or supervision of such agent, counsel, consultant or employee.
To the extent that issues involving foreign claimants arise, the Committee will consult with Melissa Ferrari, Esq., an attorney who has represented non-Domestic Claimants in this litigation, as the Foreign Claimant Liaison Counsel to the Claimants' Advisory Committee.
The budget for the Claimants' Advisory Committee and its counsel has been approved in the 2004 budget.
