The Official Committee of Unsecured Creditors (the "Committee"), having filed its Ex Parte Motion for Order Shortening Notice of Application and for an Expedited Hearing (the "Motion"), and the Court having reviewed the Motion, and the Court having found pursuant to F.R.Bankr.P. 9006(c) and Local Rule 9006-1(b) that good cause exists to shorten the notice prescribed under Local Rule 9014-1(b)(2) for the Application of the Committee for an order authorizing the retention and compensation of Miller Buckfire Lewis Ying Co., LLC as financial advisors (the "Application"),
NOW THEREFORE, IT IS HEREBY ORDERED AS FOLLOWS:
1. The Committee's Application is hereby GRANTED;
2. Service of the Application on the Fee Parties as defined in the Fourth Amended Case Management and Administrative Order via overnight courier is deemed proper notice for the Application.
3. Counsel for the Committee shall serve the Fee Parties with a copy of this order by facsimile. The Fee parties shall have until May 17, 2004, 5:00 p.m., Eastern Time, to file and serve by facsimile any objection to the Application. Any such objection must be served by facsimile on Michael S. Flynn at (212) 450-3766, Donald S. Bernstein at (212) 450-3092, and Ogden N. Lewis at (212) 450-3476. A certification of such service shall be timely filed by counsel for the Committee.
4. A hearing will be held on Thursday, May 20, 2004, 9:00 a.m. with respect to the Application if an objection is filed and served by facsimile upon counsel for the Committee.
5. The Clerk of this Court shall return a copy of this order to counsel for the Committee, who shall effect service as provided herein.IT IS SO ORDERED.
