ORDER

PER CURIAM.

On June 20, 2024, relator filed a motion for en banc reconsideration of the denial of his petition for writ of mandamus. We DENY relator's motion.

The Honorable Patricia O. Alvarez, who was a member of the panel that denied relator's petition for writ of mandamus, did not participate in the panel's or the en banc court's consideration of relator's motion for en banc reconsideration prior to her retirement effective June 30, 2024. See Tex. R. App. P. 41.2, 49.3. Justice Alvarez's successor, the Honorable Lori Massey Brissette, participated in the en banc court's consideration of relator's motion for en banc reconsideration. See id. R. 41.2.

It is so ORDERED.
