IN THE INTEREST OF D.N.M., a Child
From the 73rd Judicial District Court, Bexar County, Texas
Trial Court No. 2014-PA-01778
Honorable Charles E. Montemayor, Judge Presiding
ORDER
This is an accelerated appeal of the trial court's order terminating appellants' parental rights. The disposition of this appeal is governed by the standards set forth in Rule 6.2 of the Texas Rules of Judicial Administration. TEX. R. JUD. ADMIN. 6.2. Accordingly, this appeal is required to be brought to final disposition within 180 days of the date the first notice of appeal is filed. Id.
Both the child's mother and father filed notices of appeal, and their appellants' briefs were originally due to be filed on December 21, 2015. This court previously extended the deadlines for filing the briefs to January 11, 2016. On January 11, 2016, both appellants filed motions requesting an additional extension of time to January 31, 2016. By order dated January 13, 2016, the motions were granted. The order stated, " THIS IS THE FINAL EXTENSION OF TIME THAT APPELLANTS WILL BE GRANTED ." The appellants' brief were ordered to be filed by January 31, 2016.
Although the mother's brief was timely filed, Joseph Bohac, the appointed attorney representing the father, filed a third motion for extension of time on February 8, 2016. The motion is DENIED. Mr. Bohac is ORDERED to file the appellant's brief for the father no later than February 16, 2016. If the brief is not filed by that date, this appeal will be abated to the trial court for the appointment of new appellate counsel, and the trial court will be instructed to consider whether sanctions should be imposed.
