On October 13, 2016, this Court's Order, among other things, directed the Clerk of this Court to file the relator's document as a mandamus petition as of the date of that Order and requested a response to the petition. Relator's petition seeks to vacate the portions of the order, signed by the trial court on September 20, 2016, granting the plaintiff's motion to compel "all documents withheld on any privilege log which include Maria Ngo as a recipient, sender, or copied person," and "produce all documents provided to and/or reviewed by Maria Ngo" no later than 10 calendar days from September 19, 2016.
Later on October 13, 2016, relator, DM Works, L.L.C., filed this motion for temporary relief to stay the first paragraph of the trial court's September 20, 2016 order compelling the production of the documents described above, pending this Court's resolution of the petition. On October 14, 2016, the real party in interest, Dimensional Machine Works, L.L.C., filed a response in opposition to the motion.
Accordingly, we grant the relator's motion and ORDER that the portions of the trial court's September 20, 2016 order requiring production of "all documents withheld on any privilege log which include Maria Ngo as a recipient, sender, or copied person," and "produce all documents provided to and/or reviewed by Maria Ngo" within 10 calendar days of September 19, 2016, is stayed. See TEX. R. APP. P. 52.10(b). This stay is effective until the mandamus petition in this Court is finally decided or this Court otherwise orders the stay lifted. See id. Any party may file a motion for reconsideration of the stay. See id. at 52.10(c).
