IN THE MATTER OF D.J., A JUVENILE

On Appeal from the 305th Judicial District Court Dallas County, Texas Trial Court Cause No. JD-20-00931-X

ORDER

BONNIE LEE GOLDSTEIN JUSTICE.

This is an appeal from an order adjudicating appellant delinquent and placing him on probation. On November 3, 2021, in accordance with Texas Family Code section 56.01(f), court appointed trial counsel Rebecca Garcia, an assistant public defender, informed the trial court that the Public Defender's Office would not be representing appellant on appeal. See TEX. FAM. CODE ANN. § 56.01(f). Although appellant declared he is unable to hire appellate counsel and requested the trial court appoint counsel to represent him in this appeal, nothing before the Court reflects counsel has been appointed. Accordingly, we ORDER the trial court to appoint appellate counsel for appellant and to transmit to this Court, no later than November 19, 2021, a supplemental clerk's record containing the order of appointment. See id. § 51.10, 56.01(f).

We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Cheryl Lee Shannon, Presiding Judge of the 305th Judicial District Court; Dallas County District Clerk Felicia Pitre; Ms. Garcia; the Public Defender's Office; and, the parties.

We ABATE the appeal to allow the trial court an opportunity to comply with this order. It shall be reinstated no later than November 23, 2021.
