ORDER
The motion to waive fees is GRANTED for this case only.
The complaint for writ of superintending control is DISMISSED pursuant to MCR 3.302(D)(2), which provides that, where an appeal is available, the complaint must be dismissed. See also Shepherd Montessori Center Milan v Ann Arbor Charter Twp, 259 Mich.App. 315, 347; 675 N.W.2d 271 (2003). Plaintiff has an appeal pending in Docket No. 365242, and the issues in this case may be raised in that appeal.
The motion to extend the time to cure defects in filing is DENIED AS MOOT, the complaint requiring dismissal.
