MEMORANDUM OPINION


On June 16, 2006, relator filed his mandamus petition requesting this Court to order the trial court to rule on his pending motion for DNA testing. On August 10, 2006, the real party in interest filed with this Court the trial court's August 2, 2006 order denying the motion for DNA testing. Accordingly, relator's petition for writ of mandamus is DISMISSED as moot. See Tex.R.App.P. 52.8(a).
