In re Attorney Fees of Michael R Dezsi

LC No. 04-012890-01-FC

Michael J. Riordan Presiding Judge, Thomas C. Cameron, Noah P. Hood Judges.

ORDER

Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application, the trial court's December 9, 2022 order is VACATED, and the matter REMANDED for reconsideration of appellant's request for extraordinary fees. The trial court granted only a portion of the extraordinary fees requested by appellant, with no explanation of why it was doing so. On remand, the trial court must explain why the requested fees were not reasonable, or alternatively, grant the request in its entirety. See In re Ujlaky, 498 Mich. 890 (2015).

The motion for peremptory reversal is DENIED AS MOOT in light of this Court's disposition of the application.

This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
