ORDER

Pursuant to MCR 7.206(D)(4) and MCR 7.216(A)(7), the complaint for superintending control is GRANTED. The register of actions reflects that the trial court has not resolved a motion docketed on October 5, 2022, in which plaintiff requested an extension of time to amend his motion for relief from judgment, nor has the trial court resolved the motion for relief from judgment on reconsideration as directed by this Court. People v Dewberry, unpublished order of the Court of Appeals, entered October 28, 2021 (Docket No. 357629). We thus DIRECT the trial court to decide the motion for an extension of time within 21 days of the date of the Clerk's certification of this order. If that motion is denied, the trial court shall then resolve the motion for relief from judgment within 56 days after entry of an order denying the motion for an extension of time. If the trial court grants the motion for an extension of time, it shall resolve the motion for relief from judgment within 56 days after the filing of the amended motion.

We do not retain jurisdiction.
