IN THE INTEREST OF D.E.A. A/K/A D.S. AND D.W.A. A/K/A D.S., CHILDREN
On Appeal from the 315th District Court Harris County, Texas Trial Court Case No. 2020-00244J
Panel consists of Justices Kelly, Landau, and Farris.
MEMORANDUM OPINION
PER CURIAM
Appellant, father, filed a notice of appeal from the trial court's October 28, 2022 Decree for Termination in this suit affecting the parent-child relationship. On December 19, 2022, appellant, through counsel, filed an unopposed motion to dismiss the appeal, stating that appellant "ha[d] informed counsel that he no longer wishe[d] to appeal this matter." Counsel stated that he had "advised appellant of the repercussions of dismissing the appeal," but appellant "indicated his continuing desire to no longer pursue the appeal."
No other party has filed a notice of appeal, and no opinion has issued. See Tex. R. App. P. 42.1(a)(1), (c). Appellant's motion includes a certificate of conference stating that appellee, the Texas Department of Family and Protective Services, is unopposed to the relief requested in appellant's motion. See Tex. R. App. P. 10.3(a)(2).
Accordingly, we grant appellant's motion and dismiss the appeal. See Tex. R. App. P. 42.1(a)(1), 43.2(f). We dismiss all other pending motions as moot.
