MOTION DECISION

An order of this Court having been made and entered on June 22, 2021 (Motion No. 2021-03981), inter alia, suspending respondent (who, as Patricia Marie De GraceD'Aliasi, was admitted to the bar of the State of New York at a Term of the Appellate Division of the Supreme Court for the First Judicial Department on September 8, 2008), pursuant to 22 NYCRR 1240.9 (a)(3), from the practice of law in the State of New York, effective immediately and until further order of the Court, based upon her failure to submit to a medical and psychiatric examination by a qualified expert or experts as directed by this Court's order entered September 6, 2019 (M-997), And an unpublished order of this Court having been entered on August 4, 2021 (Motion No. 2021-02367), granting respondent's request for a post-suspension hearing and appointing Referee John R. Horan to conduct a hearing within 60 days of the date of the order, and to file with the Court and the Committee a post-suspension hearing report containing his findings and recommendation, And an unpublished order of this Court having been entered on March 11, 2022 (Motion No. 2022-00424), denying respondent's request to assign a new Referee, And the Referee having submitted a report dated September 1, 2022 finding that respondent had willfully defaulted with respect to the post-suspension hearing, And the Attorney Grievance Committee for the First Judicial Department, by Jorge Dopico, its Chief Attorney (Yvette A. Rosario, Esq., of counsel), having moved this Court for an order confirming the findings of fact, conclusions of law and recommendation as set forth in the Referee report, and respondent having failed to substantively oppose the motion, Now, upon reading and filing the papers with respect to the application, and due deliberation having been had thereon, it is unanimously, Ordered that the motion is granted, the report and recommendation of the Referee is confirmed, and petitioner Patricia M. De Grace-DiAliasi, admitted as Patricia Marie De Grace-D'Aliasi, remains suspended pursuant to 22 NYCRR 1240.9(a)(3), and until further order of this Court.
