In re Bobby B. Dash, Relator

ORDER Trial court case number: 2017-16096 Trial court: 152nd District Court of Harris County

On May 3, 2018, relator, Bobby B. Dash, filed a pro se petition for a writ of mandamus seeking to compel the respondent trial judge to rule on his motions of summary judgment. Relator has also filed a sworn record. See TEX. R. APP. P. 52.7(a)(1). Although relator's petition notes that hearings were held on December 22, 2017, and January 19, 2018, he neither attached the hearing transcripts nor states that these records have been ordered or that no testimony was adduced in connection with the matter complained. See id. 52.7(a)(2).

Accordingly, we ORDER the relator, within 10 days of the date of this order, to file a statement that no relevant testimony was adduced in connection with the matter complained or else to provide evidence of requesting the reporter's records for the December 22, 2017, and January 19, 2018 hearings and payment for, or arrangements to pay for, the reporter's fee to prepare these records. See TEX. R. APP. P. 52.7(a)(2), (b).

Finally, the Court requests a response to the petition for writ of mandamus by any real party in interest. See TEX. R. APP. P. 52.8(b)(1). The response, if any, shall be filed within 20 days from the date of this order. See id. 2, 52.4.

It is so ORDERED. Judge's signature: /s/ Evelyn V. Keyes
