Original Proceeding on Petition for Writ of Mandamus
MEMORANDUM OPINION
Relator, Bobby B. Dash, filed a pro se mandamus petition seeking to compel the respondent district judge to rule on all of his pending pretrial motions in the underlying trial court proceeding. With the petition, relator also filed an "Emergency Motion for Temporary Relief" seeking to stay the underlying proceeding, which includes precluding the respondent from ruling on his May 6, 2019 "Motion for Additional Judicial Resources or Motion for Voluntary Recusal or Motion for Dismissal," pending disposition of this petition. No response to either the petition or the motion has been requested.
The underlying proceeding is Bobby B. Dash v. Parc Lake Estates Homeowners Association, Inc., and Carl Edward Bovermann, John Mgbere, Tracy Hermann, Cause No. 2017-16096, in the 152nd District Court, Harris County, the Honorable Robert K. Schaffer presiding.
We deny the mandamus petition. See TEX. R. APP. P. 52.8(a), (d). We also deny relator's emergency motion for temporary relief.
This is relator's fourth mandamus petition challenging the same respondent because this Court previously denied two of relator's related pro se petitions and dismissed as moot relator's similar pro se petition. See In re Bobby B. Dash, No. 01-18-00653-CV & No. 01-18-00725-CV, 2018 WL 4190060, at *1 (Tex. App.—Houston [1st Dist.] Aug. 31, 2018, orig. proceeding) (per curiam) (mem. op.) (denying two related petitions seeking to compel respondent to amend orders denying relator's motions for summary judgment or to allow an appeal); In re Bobby B. Dash, No. 01-18-00350-CV, 2018 WL 3580944, at *1 (Tex. App.—Houston [1st Dist.] July 26, 2018, orig. proceeding) (per curiam) (mem. op.) (dismissing petition as moot seeking to compel respondent to rule on relator's pending motions for summary judgment).
PER CURIAM Panel consists of Justices Keyes, Kelly, and Goodman.
