DANIELS (DAVID SCOTT) ON H.C.

Motion denied

Petitioner has withdrawn his motion for reconsideration and stay of the court's October 10, 2018, order transferring the petition under Penal Code section 1509, subdivision (g).

The request of petitioner's counsel, the Habeas Corpus Resource Center, for an order vacating its appointment or directing counsel to continue to represent petitioner in the superior court is denied without prejudice as follows. The portion of the court's October 10, 2018, order retaining jurisdiction over all matters concerning the appointment of counsel for petitioner is hereby vacated. The superior court is directed to consider whether the appointment of the Habeas Corpus Resource Center as petitioner's counsel can and should be maintained or the superior court should vacate that appointment and appoint new counsel. This court no longer retains jurisdiction over any aspect of this petition.
