Opinion

No. 623, 2005.

Decided: January 26, 2006.

Court of Chancery of the State of Delaware in and for New Castle County, C.M. No. 12203-NC.

ORDER

This 26th day of January 2006, it appears to the Court that the Clerk of this Court issued a notice to show cause to the appellant, Richard Sansbury. The notice that issued on December 16, 2005, pursuant to Supreme Court Rule 29(b), directed that Sansbury show cause why this appeal should not be dismissed for his failure to comply with Supreme Court Rule 42. Sansbury did not respond to the notice to show cause. Thus, the Court's dismissal of this appeal is deemed to be unopposed.

NOW, THEREFORE, IT IS ORDERED, pursuant to Supreme Court Rules 3(b)(2) and 29(b), that the appeal is DISMISSED.
